Can probate take a life ins policy left for the family?

Generally, Probate does not affect Payable on Death accounts such as life insurance policies. Just make sure that a beneficiary was named. The reason is that the money never was part of the deceased's estate. It passed over them to the beneficiaries.

No. If the life insurance has a named beneficiary, the it transfers outside of probate.
