Legal Question in Wills and Trusts in California

Will executor of will have to cover hospital bills?

If someone is designated as the executor and/or beneficiary in a will, will that person be responsible for hospital bills? If so, what is the benefit of naming them in the will? Would the life insurance also be targeted by hospital bill collectors?

The only person/entity liable for bills is the estate itself. If the estate has inadequate funds to pay all the creditors, then the creditor, after submitting a claim to the estate, would only receive part of their money back. Life insurance goes to the beneficiary named in the policy and is not part of the estate so can not be gone against for the bills.

The only person (entity) responsible for a decedent's bills is the decedent's estate.

The life insurance goes directly to the beneficiary. If the decedent's estate is named as the beneficiary, then the money may be used to pay the decedent's bills. Otherwise, it will not.
