Legal Question in Workers Comp in California

4 years ago I had a bad accident at work. I was out for 3 months to get on meds for Tramatic Stress from the event. The meds made me tired and my performance for last 3 years went from excellent to okay. Now I have been fired for performance and I can not afford my meds or to see my Doctor. Can I re-open this claim so I can get the meds that I need while being unemployed and under Dr Care for psychiatric reasons due to the accident 3 years ago. I am on disability right now, but have no medical benefits. Due to being on the meds since the accident, I have had confusion, memory problems, etc... I need to see a Dr. for therapy.

If you entered into a Compromise and Release, you're effectively done. However, if you stipped your claim, you have 5 years to reopen, but only if you suffered a new and further injury, or, if you suffered a compensable consequence (which could extend beyond the 5 years), you can amend your claim.

Under certain circumstances the court will set aside a compromise and release, which appears to be how you settled your case because you no longer have medical coverage. However, losing a job for performance issues is not something I believe the could will re-open the claim for. You might consider a discrimination claim, as you were handicapped after your injury. Yet, again, the performance issue will generate lots of problems since the employer will claim a good faith personnel issue for all claims you might bring.
