Legal Question in Workers Comp in California

Changing Doctors

My husband was laid off from work due to a back injury sustained while at work. He filed for worker's comp and retained an attorney who chose a doctor for him. Worker's comp has since issued him a ''final check'' and he now received disability. We have since moved to Oregon. He is now under my insurance and wants to see a new doctor. Both his lawyer and his doctor say that he is not allowed to see anyone else. What options do we have? He is unhappy with the care he is being provided and we can't afford for him to travel to California to see this doctor.

The labor Code allows an injured worker to change physicians. However, if the physician has been designated by the court, you may need a court order to change.

The problem you will have in Oregon is finding a physician fluent in California workers compensation reporting requirements. If the new physician fails to properly report, the carrer may petition to stop treatment and/or designate their own physician.
