Legal Question in Workers Comp in California

Should I file a claim before seeing an attorney?

I am employed by a major retailer as a department manager. I had gastrointestinal problems and believe it is due to hostile work environment and undue stress at my work. An attorney's office told me I have to file a claim with the store before he will see me. Is this true, or should I see an attorney first? This company is the biggest retailer in the world, and I know it will be tough to get a good settlement. Can you refer me to a qualified professional that will do good against such a company? I am in San Luis Obispo County.

notice

you must in any case file notice of an injury with your employer. you have one year from the date of injury, which in your case may be hard to determine. if your employer receives no notice, then you cannot file a worker's compensation claim under current law.
