You are asking attorneys to answer a medical question. With back fusions there are so many variables that I doubt anyone can answer your question without first reading the medical files.
At this point the only suggestion I can make is that you settle the case by Stipulations with Request for Award because back fusions tend to be unstable and complications develop in the vast majority of cases.
