Legal Question in Workers Comp in California

injury while working for temp agency

i was hired by a temp agencey last week. On my first assignment i was injured. I recieved 2nd and 3rd degree burns on my foot and was placed on '' limited work.'' The temp agence is unable to find me work that fits in with the doctors instructions, which are no standing. I understand since i am a mechanic, and it would be difficult since this no one is gonna pay me the temp agency for my services if i cant perform. Im confused as too what kinda wages i can claim for the injury. I know my medical will be taken care of. But i will be unable to work for 3 weeks according to doctors. Also if i make 21 dollars an hour as a mechanic can they pay me 12 dollars an hour to answer phones? Also when would i recieve payment if at all? Thank u in advance

Re: injury while working for temp agency

YOUR INJURY SHOULD BE COVERED UNDER YOUR EMPLOYER'S WORKER'S COMPENSATION INSURANCE COMPANY. IN YOUR CASE THE TEMPORARY AGENCY IS YOUR EMPLOYER AND MAY CARRY WORKER'S COMPENSATION INSURANCE. YOU ARE ENTITLED TO TEMPORARY DISABILITY BENEFITS WHICH IS WAGE REPLACEMENT AND IS 2/3 OF YOUR NORMAL WAGES. YOU MAY BE QUALIFIED FOR VOCATIONAL REHABILITATION AS WELL, IF A MODIFIED WORK CAN'T BE FOUNF FOR YOU.

I RECOMMEND AME(AGREED MEDICAL EVALUATION) TO FAIRLY EVALUTE YOUR CASE.CONTACT MY OFFICE AT 213.388.7070 FOR A FREE CONSULTATION ABOUT YOUR CASE.
