Legal Question in Workers Comp in California

I schedule a QME on 6/22 and it was scheduled for 7/14 at 8am. I sought representation on 7/13 and signed the agreement at approximately 4:30pm. The insurers WC attorney is trying to throw out the QME because they want an AME since I was represented. The insurer only gave me ten days to file for a QME and 10 days to request a doctor once I received the panel. The expiration of that would have been well before I obtained legal representation. Can this QME be thrown out? It's was suppose to determine whether the injury was work related (QME said yes).
