Legal Question in Workers Comp in California

work comp

I just quit my job after 6 years. I was on disability for 2. After my second qme visit the insurance company said I cant go to the doctor anymore but never offered me a settlement of any kind. Is my claim still open should I act now? I still have wrist problems. I talked to a lawyer a while back and he said he can't do anything because I chose a QME without the help of a lawyer . What can I do? Will my claim just evaporate into thin air?

Re: work comp

While I am not up to date on all of the recent changes, previously you had 5 years from the date of injury or one year within the last date you received any type of benefit, including payment of a medical billing, to file a formal Application, and the WC insurance company had to notifiy you of the limited time period. Contact the WC carrier and check on the status of your case and if you can now go forward with it. If the say yes, get the name, telephone number, and position in the company, including whether has authority to bind the company, in case they later deny it.
