Legal Question in Business Law in Canada

Contract Law Question, Under the influence

Have a question about a legal issue. If a legal contract was signed in Toronto, Canada, under the influence of alcohol. What is the binding power in the State of Kansas. Also, what can be done to get out of it?

Re: Contract Law Question, Under the influence

Hmmm, interesting question. You may be able to claim that you lacked capacity to make a decision regarding the contract and thus there is no contract as it is void from the get go. The more difficult question is whether you can bring an action in Kansas. I or any other attorney would need more information on whether the other party has sufficient ties to Kansas upon which to base jurisdiction over that person.

Thank you for your question.
