Legal Question in Family Law in Canada

Regaining my property

My common-law husband and I own title to a trailer home.He will not let me back in the home. The police will not help. Our home is being used as a flop house for drug and alcohol addicts. I fear for the safety of the home and my possions. How do I get him out of the house. I can not afford a lawyer and I cannot get legal aid.

Re: Regaining my property

This answer pertains to British columbia only. The police will not assist because this is a civil matter and the police are concerned with criminal matters; they have no authority to deal with private civil disputes. You have 3 choices: (1) Start a lawsuit yourself for possession of the home (and other relief as well); (2) Hire a lawyer to do (1) for you; (3) do nothing and walk away from the home, knowing that you wil likely still be liable for any money owing on it (mortage, taxes, utilities, etc.) and may be laible for any harm that occurs to people while at the home. There are no other options.
