Legal Question in Medical Malpractice in Canada

Patient Medican Charts

I requested a copy of my entire chart

(which is about 4 inches thick) from

my PCP--they told me it would cost

me 75 cents per page. Recently, for

certain other reasons, I have decided

to discharge myself completely from

that doctor's care, but they insist

that I must still pay the copy fee in

order to obtain my charts. However,

if I am no longer a patient there,

aren't the charts my property, and

shouldn't I be able to get them

without paying close to 200 dollars?

Re: Patient Medican Charts

The Public Health Law permits this charge...no one works for free... you are getting your records...you are paying the reproduction costs.

Good Luck
