Legal Question in Real Estate Law in Canada

Illegal Trepass

I own 5 acres of land in a farming area. My land is wooded. A farmer constucted a dirt/gravel road on an existing over grown pathway for access to his land without my knowledge or permission. I have asked the farmer to cease the use of my land and also restore the land to its previous condition so that no vehicles are able to have access. To date he has not complied. What is my recourse with the court in this situation. It has been two (2) years since my original request for him to comply.

Thank You

Re: Illegal Trepass

Sue for trespass, incjunctive relief, and claim damages in the reasonable rental value for the une over the last 2 years, plus the cost to restore the property. Good Luck,
