Is there a penalty for under age sex?

I'm 17 and my ''Girl-friend'' is 16. Last night we were caught by her mother having sex. We have had sex before but this is the first time we were caught so the feelings were mutual. Her mother kicked me out of her house and told me she was going to talk to the police about this. Is there anything that I can be charged with?

I assume that you are not in a position of trust - meaning a teacher, coach, baby sitter, or someone that her parents have entrusted to care for their daughter. It does not sound like it. If so, then you have a serious problem.

Sex assault on a child requires the victim to be less than 15 and the perp to be 4 years older than the victim.

Sex assault requires the victim to be 17 or less and the perpetrator to be at least 10 years older. Or that she does not consent or is drunk etc.

It sounds like you are in the clear. I am sure that her mom is just pissed off. Call me if you have more questions.
