Legal Question in Civil Rights Law in Colorado

Is swearing illegal?

I am having a dispute with my neighbor and I told him he was acting like a whiney bitch. He called the cops and I received a ticket for using illegal language. Is it really illegal?

Re: Is swearing illegal?

If that is all that you did, no, and you should fight the ticket (fighting it will likely get it dismissed).

If there was more you've neglected to mention, such as that you repeatedly called him a whiney bitch, did it in public, or otherwise harassed the poor whiney bitch, then you may have more difficulty.

Look at the statute or ordinance you've been cited under, then look at the language of that statute or ordinance.

The cop probably issued the ticket just so he didn't have to talk to either one of you any longer than necessary.

Fight the power, and good luck.

I don't think calling someone 'whiney bitch' is illegal. However, you may kindly check as to under what Section of which law the ticket has been issued to you. Then you may check that section to find out whether that section provides for ticket in such a situation. If not, then you may probably sue the cops for exceding their powers.
