Verbal Contracts

are verbal contracts legal and binding in this state?are they if broken, binding in small claims court?

Verbal contracts are legal in all states for most purposes other than real estate transactions.

The problem is they are usually quite difficult to prove.

They are enforceable in small claims court if you have courtroom-quality evidence [usually an independent witness or two] of the terms of the agreement.

Most often there is no independent witness and the hearing ends up in a "yes-you-did" - "no-I-didn't." You can't win that game, as you need more pebbles on your side of the scale than the opposition.
