Legal Question in Criminal Law in Colorado

impersonation felony

my fiance' gave the sherriff a family members name who had a warrent he however under his true name had no warrent he then gave his name but was taken in for impersonation his court is on tue 2/08/05 he has no prior offences this is a felony and i am wondering about possible consequences,and he has a public defender.

Criminal Impersonation is only a felony if they can prove that the person assumed an identity for the purpose of gaining an unlawful benefit for himself or to defraud another. It sounds like just the opposite happened. he "assumed an identity" that actually was detrimental to him. If they do not have the unlawful benefit element, it sounds like the charge would more appropriately be a misdemeanor False Information.
