Legal Question in DUI Law in Colorado

Alcohol at weddings

If we provide the alcohol at our wedding we were told we are responsible for our guests if they get into an accident or get a DUI. We plan on providing a shuttle to a near-by hotel. We are still worried about those who drink and decide not to use the shuttle. Is there a way we can have our guests sign a waver saying they are responsible and we are not?

Re: Alcohol at weddings

First, you are not "responsible" for a guest who gets a DUI. However, you may be found responsible for a guest who gets into an accident. Who is providing the alcohol at your wedding? If the alcohol is provided by a hotel or a catering company, for example, you would be more protected from any liability; the liability in that case would more likely fall on the hotel or the catering company. Having your guests sign a waiver is also helpful, although it's not going to insulate you 100% from any liability. (It's also not very hospitable.) The more appropriate thing to do is close the bar at a reasonable time, and openly and loudly remind everyone to drink responsibly and do not drink and drive. Also, take reasonable steps to ensure that people do not drink and drive, such as appointing a key monitor.
