Legal Question in Family Law in Colorado

Custody of Children

My wife has asked for a divorce and wants to take our 3 children. I want custody and my children want to live with me (at least the oldest 2). My children are 7, 5, and 2. At what age will the court allow children to choose which parent they live with?

There is no set age. The court will consider the children's maturity level. At 5 & 7, the court will more likely rely on the recommendation of a special advocate appointed to interview the parents and children.
