Legal Question in Family Law in Colorado

divorce court order

I divorced my ex-wife in May of 2007. I agreed to and was ordered to continue making the payments on her car ''until the car was paid off''. At that time, there was still $10,000 owed. She traded the car in March of 2008, so no longer has the car I was ordered to pay for. I have continued to make the payments to her directly. However, it seems that by her trading the car, I would be freed from that obligation. Since she no longer has the car, am I liable to keep making these payments, and do I need to petition the court for modification in the original order? Thank you for a timely response.

Re: divorce court order

You should be released from the obligation to pay your ex-wife payments for her car, because she no longer owns the car. However, please note that to be released from this obligation, you will need to request a modification of the divorce decree from the Court. Please feel free to call or email if you have any questions.
