Legal Question in Civil Litigation in Colorado

Libelous statements made on an internet public forum

An Amazon.com Marketplace seller stated what may be libelous comments on the Amazon.com feedback forum. These statements accuse me of having somehow changed the seller's prices to ''get books cheap'', although it is impossible for me to have done so. And, to have done so would have been a violation of the law on my part. Therefore, I feel that I am being accused of criminal activity. Although the statements are untrue, Amazon.com has refused to remove them from their public forum.

As I am also an Amazon.com Marketplace seller, these statements have and will affect my business. Furthermore, these statements have caused me emotional distress.

What recourse do I have, and how should I choose an attorney to handle this matter?

Thank you

Wow. The toughest part of defamation law is proof of damages. These comments "may" affect your business, but until they do and do so in a significant way, the cost you'll incur likely will outweigh the benefit to be gained. I'd don't think you want to move forward with speculative damages. That's my 2 cents. I recommend you look for an attorney who practices in the area of "cyberlaw" who will have experience in dealing with the nuances of how info/comments are made, changed, etc. You might not need that expertise, but it would be helpful to have it if you do. See if there is a category (practice area) listed for this via the Colorado Bar Association website at www.cobar.org - use the For the Public tab, Find a lawyer and look by category. If nothing is there for cyber/internet law, then look for attys who list privacy/defamation/1st Amend practice - if they work in the defamation area they may well have experience with internet based scenarios.
