Legal Question in Landlord & Tenant Law in Colorado

Eviction/Name on lease/No longer Resided

I'm not sure, and most-likely can't win this, But, almost 2 years ago I left my abuseive ex-boyfriend. I talked to the apartment office and couldn't have my name taken off the lease but I moved any way. Well he and our ex-roommate wound up getting evicted a month or so after wards. Now he wants to take me to court for payment on the eviction. I was wondering if I can prove I was no longer living at the appartment if it was possiable that I wouldn't have to pay.

Re: Eviction/Name on lease/No longer Resided

Afternoon,

Sorry about the problems, but the fact that you moved does not release you of the lease obligations.

You may have a defense of failure to mitigate (which means that he should have sought a new roommate) and some other issues, but he can certainly sue as can the apartment.

Contact an attorney or legal aid (if you qualify). Good luck.
