Legal Question in Landlord & Tenant Law in Colorado

My husband and I have a tenant who has not paid his rent for almost a month. He is threatening us and we wish to evict him. We handed him a letter stating either pay the rent or consider the letter notice of eviction. We also mailed a copy of the letter to the house he occupies with his wife. My question is: Do we also have to send him the letter registered mail or some other way. We are in Colorado and found out we must get the eviction notice signed by a judge and delivered by the sheriff's department. Also we must give him 30 days notice. Please help us out. We are an elderly couple and have a mortgage on the property in question. Any assistance you can give will be gretly appreciated. Rose Corey

You need to proceed to evict this tenant if they are not paying as agreed. The Colorado Judicial Branch site is the best place to start your research http://www.courts.state.co.us/Forms/Forms_List.cfm/Form_Type_ID/28

If you have never done an eviction before, I would strongly recommend that you at least consult with a local real estate attorney. You must follow the rules for posting, service, and procedure to the letter.
