Legal Question in Real Estate Law in Colorado

sell of house/quick claim deed/second mortgage attached

In August of 2006 I quick claim deeded my house to a person who then in turn sold the house within 48 hours. I gave the person who I quick claimed the deed to the right to go after my ex for the second mortgage which was his to pay per our divorce decree. The person who took over the house with the quick claim deed paid off the second and I believe he set up a contract with the new owner to pay the second to him. Said person who sold the house is now trying to get me to sign over my rights to my divore decree to go after my ex for the money. Can said person go after the same debt from two people? I can't get said person to give me any information on the closing documents of the house but he is calling me saying that I have to sign off my rights per our agreement in a binding contract that we signed. The contract that I signed states that I will assign and transfer to the Buyer all of the Seller's right, title and interest in and to said indebtedness. I never sold the house to him, he wanted me to quick claim the deed to him at the closing for the other person. How can I get paperwork to see if he even put the house in his name and if he has an agreement with the new owner to pay said second off? I am feeling very harassed

You really need an attorney to review the contract. Without looking at the exact terms and background to this transaction it is impossible to say for certain what your rights are and any issues.

Moreover, these quitclaim plans are often problematic because they are written with loads of unilateral rights and unfair provisions. Did an attorney review this contract on your behalf?

Contact a real estate attorney before you proceed further. Good luck.
