Refund from Wedding Photographer

Hello,

I recently met with a wedding photographer. After a few days to decide and review finances, I decided to move forward with this photographer. I signed the contract she had left with me, and sent it along with a $1500 deposit. The contract was signed by me, but not by the photographer. Prior to her receiving the contract, due to unforeseen circumstances, we had to cancel her services, because the wedding is not happening as planned. The wedding would be 8 months away, which I find ample time for her to book another job. Also, she refuses to provide me with the name of the couple who she supposedly turned down because we decided to go with her. This is something I'd like to verify with the couple to see if damages actually occurred. I stopped payment on the check, and sent her an e-mail notifying her of our cancellation. She has called me no less than 10 times in a week, and is demanding the $1500. I did not consider the contract to be final, because I had posed several questions to her, that I enclosed with the contract. She is now threatening legal action. Any advice would be greatly appreciated! Thanks in advance.

Under the general law of contracts, a contract does not need to be in writing to be enforceable. There are several ways to enforce an agreement without the signature of the other party. However, as a defense to the enforcement of the agreement, you can claim unforseen circumstances prevented you from performing the contract.

A complete answer would take a long time to type. The basic point is that the photographer may enforce the agreement. But you also may have a valid defense to the enforcement of this contract, impossibility or impracticability.
