Commitment Ring/Engagement Ring

I am in the middle of a divorce after being separated for 6 years. I have been dating a man. Last year my Dad was very ill and this man gave me a diamond ring (not expensive - paid $500) to show his commitment to me before my Dad passed away. Recently we have had many arguments at which point he tells me, ''thats it, we are over''. This is always followed up by a phone call asking me for the ring back and telling me he will see me in court. He calls it an engagement ring and I see it only as a sign of commitment, seeing that I am not even divorced I cant be engaged. Do I have to give the ring back. While together I lost approximately $400 a month for 6 months due to having to drive and pick up his autistic son from a group resulting in loss of hours for me at work. I feel that I should be allowed to keep the ring.

The ring was a gift. Very unlikely he'd get it back; but even if he tries, he'll be taking you to small claims court, so you'll miss what, maybe a half day out of your life. My bet is he does nothing.
