Who has legal custody of a minor child in the case of married but seperated with no paper work filed?

Until a court orders otherwise, you have joint legal custody.

That means not only do you have an equal say in the child's education, health and welfare, etc. BUT either one of you can take the child out of the state (country) without being accused of kidnapping.
