under the law, it states that the person or persons, are liable for any and all damage to private property

my question is?

if the person is willing to pay the person for the broken property, thus buying them a new one Is the defendant still liable for any repairs that are made?

I am not clear what your question is but I will take a wack at it anyway.

You can't double dip. If the defendant replaces the property that's it. He can't be expected to pay for repairs as well. It's one or the other.
