Roomate Abandon Property

I have not heard from my roommate going on three months now, I am not on the lease of the place that we have rented and will be moving out in five days. I have been told to move all the belongings out, do I have the right to sell her stuff or do I need to place it in storage? She has also left behind her cat.

Is your roommate on the lease? Have you seen the lease? If she is, does the lease indicate what happens if the tenant leaves their belongings? This may be an issue between her and the landlord, however, there may be language in the lease that indicates what happens if a tenant abandons the leasehold.

Since you have been there for 3 months without a lease, the question becomes whether you are in fact on a month to month lease as opposed to the written lease that you are not a party too.It appears from your question that you and the landlord treated you as the tenant to the lease, but I can not be sure from the facts in your question.

I can't answer your question without more information, however, I don't think you have any responsibility to protect her property, unless you had a verbal agreement. You may want to send a certified letter to her, or the landlord might want to do so, just in case.
