Legal Question in Legal Ethics in Connecticut

Should he have recused himself?

I filed a grievance complaint against an attorney in the state of Connecticut. The attorney retained counsel; I did not. A hearing was held on the grievance complaint issues. After the hearing a committee met to review the information. It has come to my attention that the Chairperson heading the committee is a law partner to the attorney representing my former lawyer at his grievance hearing. Should this Chairperson have recused himself at the hearing and/or do I have a legitimate complaint against the Statewide Grievance Committee for allowing the Chairperson to take part in the ultimate determination of my grievance complaint?

Thank you for any input.

Re: Should he have recused himself?

The situation you describe, if accurate, is a classic conflict of interest situation.

You should report this information to the diciplinary board.
