It is impossible to say without getting detailed information from you, reviewing medical records, and determining the available insurance from the other driver. If you were injured as well as your son, you would file one lawsuit with both of you named as plaintiffs. This type of matter would be handled on a contingency fee basis, so you would not be spending money on legal fees in the absence of a recovery.

There are too many unanswered questions here. You really need to consult with an attorney, but where there is no real injury, you can't expect much. The ins. co's are paying between $500-1500 per person. You are probably looking at $1000-2000 total for you and your son, but... you still need to speak with an attorney. Without a serious or permanant injury, it's not worth filing suit.

You also want to wait for a period of time to see if any soft tissue injury surfaces before accepting any settlement. An attorney will be able to help you decide what period of time is prudent to wait.

If you want a referral in DE, try Paul Wernle, at 302-221-3342. He's a straight shooter, and I've seen him get more than I'd expect on numerous occasions.

I'm glad you weren't seriously hurt. Good luck to you and your son.
