Who Has rights to business phone

Oral agreements to buy family owned business..... recipts of ten payments made towards business of agreed amount. Now family feud, the business was never in anyones name ( not fictious or co regiesterd with state. We filed and were aproved llc for co But we can't get the business phone switched to us even though paying out of our bank account for the phone cause it registerd to company name and father in law. But we are paying for them to recived and conduct business on this phone line ... Is there any way showing we legally own the co that we can force the phone co to transfer payments and number to us or either force them to shut off the phone being its advertising our company and provings coustomers to palce the number is at?

Any agreement to purchase or acquire a business should be in writing. It is difficult to determine without a signed writing what the intent of the parties are and what part of the business is being sold. It is possible your family members could agree to sell a portion of the business which did not include the phone lines. If both parties are in agreement on this acquisition then there should be no reason to avoid having a written agreement. You sound very agressive in trying to takeover the business and your family does not sound very cooperative. You should retain counsel to help negotiate and put into writing the terms of the acquisition of your family's business. 305-670-0373
