I am being sued

If someone is suing me for the refusal of payment for a piece of artwork that I sold, can I simply just return the artwork to them? As appose to paying them? The client is refusing to pay the amount the artist wants to recieve for the painting, however, the artist priced the piece at $300 for the show, but is suing me for payment of $500. I have already been subpeoned to court, but would like to simply return the artwork to the artist as agreed upon myself, the curator, and the client. I have also been slandered by this artist to over 50 different artists that I currently work with, do I have a counter suit for defamation of character?

If you agreed to buy it for $300, you can't avoid that simply because the person you were going to sell it to changed their mind (unless that was part of your original agreement with the artist). Perhaps he or she will take it back, though. Never hurts to ask.
