Unauthorized Internet Photos from Work

My former employer is refusing to take a picture of the his internet site. He took off my staff picture but did not take off one of me sitting at my desk. It has been 2 months. He does not have anything signed by me authorizing the use of my photo (no application, no release, no w-4, nothing). He uses his website to promote his physical therapy practice. Thank you for your assistance.

Generally speaking, the commercial use of the likeness of another [photograph] entitles the subject to compensation when no permission has been given for that use. Consult an attorney in your area - initial consultations/case evaluations are usually done at no cost.

The employer has no right to use your photo under the facts that you outlined. The best bet is probably to hire an attorney to draft a demand letter that he cease and desist. If you want to discuss this further, please call for a free consultation.
