Legal Question in Consumer Law in Florida

I paid for business cards and gave the correct information to the people that designed and printed them. However the put the incorrect phone number. I did initial a photo copy of the card that I received it and did not notice the error till I got home. They are now saying that what I initialed is proof that everything was ok and that it doesn't matter that they had the correct information in the first place and I would have to pay for reprint. Do I have any rights or am I stuck paying for something I can't use?

Your rights depend on whether the photo copy was initialed BEFORE they printed the cards, or AFTER they printed the cards. If you ok'd the proof before they printed the cards, then you must pay for the printing, because the printer resonably relied on your ok of the proof as accurate. The purpose of having you initial the proof was to shift the risk of error from the printer to you.

If you ok'd a copy of the card after the printing was complete, you have a better case, as the error had already been made by the printer, and he was not relying on your ok to print the cards.

You should be able to negotiate a reprint of these cards, with the correct phone number, either for free, or at a reduced price. Most printers would rather have a happy customer than no customer.
