Television Warranty

I bought a Magnavox tv this year.It broke and they set me up with a third party to repair it.The repair company never came out and kept saying they were waiting on the part,or that they had a defective part. We have waited almost 6 weeks for a repair on the tv.When I call Magnavox they keep saying they will get back to me when they research the case,but I keep waiting week after week.I would like to know if, and how I should go about getting this resolved and if they could be liable for mental anguish from all the stress this has been causing me and my wife.

You do not have any claim for mental anguish from the incident of which you are complaining. You do have a right to have the television repaired in a timely fashion, however. I would call the corporate office of Magnavox tomorrow, and tell them that if they do not have your set repaired or replaced within 7 days, you will take it to a facility of your choosing and hold them responsible for the costs of any repairs. If they refuse, then you have the option of repairing the television and suing them for all costs involved.

Florida follows the impact rule, which in almost all instances requires a physical injury in order to recover pain and suffering damages. You may have a claim against Magnavox depending on the terms of your warranty for the value of the repair.
