check into cash policy

i got a loan thru a check cashing place. of $500. I lost my job and was unable to pay back the amount. Can they have you arrested for not being able to pay? I was told they could have you arrested within 48 hrs. without a certified letter, under the bad check law. is this true? i didn't buy goods, they held a check for a loan. please help...

No they cannot have you arrested. They can sue you for repayment.

No, taking a document they knew to be a bad check at the time it was written for the purpose of threatening you with arrest for nonpayment of a loan is itself illegal.

The threat to have you arrested may have been the crime of extortion (attempting to obtain something of value through threats, force, or intimidation). It's probably also a violation of the Virginia Consumer Protection Act.
