Legal Question in Credit and Debt Law in Florida

Debt Collection - Small Claims

I'm being sued in small claims by a debt collector for about $2724.42 plus interest ($209.59) and court costs. The debt is from a credit card (that has a $1k max). I really don't have any legal experience so I'm not really sure what to do. I have no problem paying part of that amount, I'd be happy for something around the $1000 to $1500 range if possible. This is from years ago when I was young and stupid, and I really don't have any of the original documents. Any help here would be greatly appreciated. I'd like to be able to settle this with the plaintiff before the court date if possible, but I'm not sure what the best way to proceed with this is. One last thing, if you know what I can expect in terms of court costs too, I'd appreciate it. Thank you so much.

Re: Debt Collection - Small Claims

The credit limit has nothing to do with the balance, so put that out of your mind. Call the attorneys who filed suit against you (NOT anyone else) and make them the same offer. If you are serious, you should be prepared to pay in one payment (if you think you are going to pay $1500 on a a debt of $2700 over time, you are very much mistaken).

The filing costs is $255; the costs to serve the lawsuit are anywhere from $20 to $50.
