Legal Question in Credit and Debt Law in Florida

Failure to file paperwork

I puchased a vehicle, I went to the dealership with a check from my bank. The check had a expiration date of Sept 14. The dealership failed to process the check in time, therefor the check was voided. The dealership wants me to surrender my vehicle to them. Is this legal? I am being punished because they failed to process the check in a timely manner. Can the dealership take my vehicle? Do I have any legal rights?

Re: Failure to file paperwork

If you want the car, tender payment with a current check or other good funds. It is improper to keep the car and not pay for it.

Should the dealer reject your tender, let a court decide. You are probably best to retain counsel to put the pieces together.
