Legal Question in Credit and Debt Law in Florida

judgements, what can they take

I had made arrangements for payments for a credit card I owed, but since then I have become disabled and unable to work. I filed for disability but as of Aug.06 I have not had any income except borrowing and a tax refund. I am out of money and can not make the payments and have trried to get them to give me a couple months till I hear of my disability. They hung up on me and are going for a judgement. Can they take a car that has 2 names as owner, my minor daughters or my kids bank accounts, which there is hardly anything in them. I also have a couple other cars that are old and not running very well. Can they take them? What exactly can they do or take. ? Can they garnish my little disability check I may get? What about my social security check? If I am accepted. They were very rude and hung up on me. I was very honest with them and said I would pay them as soon as I get some money. I have no money for even my car insuranance.

Re: judgements, what can they take

Once there is a judgment entered against you, they can levy on your automobiles, but it is very unlikely they would. It would cost them more in time and effort than what the cars are worth.

They can garnish bank accounts with a judgment. Your social security check, and probably your disability check are exempt from garnishment.

It doesn't matter if they are rude. The law does not require them to be pleasant to you.
