Legal Question in Criminal Law in Florida

Ajudication withheld

Back in the early 1990's i was arresested on drug charges--a couple of felonies and a couple of misdemeanors--when I went to court for sentencing I was placed on a year probation and had over $1000 in fines and the judge withheld Ajudication. I know that means not convicted --I am now trying to get a job with the school board and on the application they ask if you have ever been convicted of a crime(felony) How should I respond to this? When I look up my name with the FDLE it is there and shows that I served probation. should I volunteer the information or shoud I just refrence the case #'s and let them do the research? I know that when you apply to the school board they require the disposition page what does that tell? thanks

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You should be totally honest with on your application and not make the school board find out the information on their own. From experience I can tell you that you may get hired with a provisional teachering license, but the State of Florida will do a thorough search and everything will come out. If the school board finds that you lied or were less than totally honest on your application, you will be fired and lose any opportunity you might have had. Further, your teaching license may be denied by the State of Florida and your only possibility of review is before a panel in Tallahassee which is both time consuming and costly.

Re: Ajudication withheld

You should be honest and straightforward. The thought that you would question how to answer a question for the school board is troublesome. You have not been convicted so you can say "no". They will ask for the crimes and you must disclose.

Re: Ajudication withheld

You should divulge it. Honesty is best. If you want to seal it in the future, give me a call. It won't help you with a school board job, but can help in other situations.
