Legal Question in Criminal Law in Florida

Expungement question

I was recently arrested for grand theft. Upon going to court to plea, The charge was changed to Scheme to defraud. I received a withhold of adjudication, and received a year probation. Can this record be sealed? I have a job interview coming up, and I would hate if this would stop me from getting back on track. Thanks in advance.

Re: Expungement question

You may be able to get the charge sealed, but not expunged. It depends under which statute you were prosecuted. If I remember correctly, under FL stat 943.059, Sealing of criminal history records, a fraud charge under Fl stat 917.034 Florida Communications Fraud Act can't be sealed. However, if you were charged under a different statute, you may be able to get it sealed. Call me for a free consulation at I-95 and Southern Blvd, 1/2 mile west. Grey Tesh
