Filing time for DUI
On a DUI arrest in the state of florida, if you sleeping in the car with the car running, but parked legally on the side of the road in a residential area. Does the officer have the right to detain the driver and ask questions, about being DUI? In addition what is the time period that the state attorney's office has to file on the DUI arrest, based on the fact that the breath test was zero and waiting on urine results.

yes sleeping behind the wheel is dui. they can file within the statute of limitations which is at least a year
