Legal Question in Criminal Law in Florida
juvenile entered store under construction that had no wall or doors. Appeared completely empty. Came to far back room, no door,with a light on which had items stored in it. They were seen on surveyance camera and prop. manager, told them to leave and wait by car. They left, but got scared and ran. Eventually went back to scene on advise of father. They did not leave the building with any items. Officer charged all three boys separately with Burglary Structure Conveyance Unarmed WO Person Inside AND Larceny Theft $300 or More But Less Than $1,000. No prior record or trouble. These are 3rd Degree Felony Charges!!! Officer said he believes they were "intending" to steal and that they attempted to remove property. They were not in the process of leaving. They were not looking to steal, did not even think there was anything in the building.
