Legal Question in Discrimination Law in Florida

Workplace discrimination

I recently resigned from a corp. where I had gone through an intimidation and discrimination arbitration case. The Corp. decided to just sweep the issues under the carpet'' and proceed as though nothing had happened.

I was left to assume that things had been resolved in my favor but my position within the department was undermined by the manager other support staff. Little future existed at that stage, and non-professional actions continued so I decided to resign. I had enjoyed the work and brought much value, innovation and savings to the company. Normally I would not have considered resignation.

Issues as follows:

-Favoritism with promotions, recognition and increases based accordingly

-Non-fulfillment of verbal and written agreements

-Exclusion from advancement opportunities

-Undermining of my position

-Sexual orientation discrimination

-No formal written conclusion from the company to any of the issues

-Isolation of my department from necessary resources and progress considerations.

Am I able to sue this employer? Would it be better to initiate a class action lawsuit along with other employees that have similarly resigned,or been laid off improperly?

Re: Workplace discrimination

You have many issues in your letter, some of which raise flags and might form the basis for a discrimination lawsuit. Additional facts are needed before one could say with any certainty that you have a case here. I would suggest you speak in detail with a couple of employment lawyers who could offer advice after seeing the big picture of what was going on with this employer. You may also want to check out the EEOC web site at www.eeoc.gov for assistance in filing a charge of discrimination.
