my son has gotten his third dui, in Michigan. After his hearing he will be moving to Fl. Does the state of Fl. allow you to expunge your record for a none volient crime.

You can only expunge if you have no other convictions and the court withheld formal adjudication. In Florida a judge cannot withhold adjudication by statute. So put more simply, no.

To answer your question in the best possible way the answer is no; your son will not be able to expunge his record in Michigan or Florida. Being a member of both the Michigan and Florida Bars I can tell you plainly that any conviction for a traffic offense (DUI) cannot be expunged. Also, if the defendant has more than one conviction of his record he will not be able to expunge. Being that your son has two other DUI convictions, this will also not allow the expungment. Sorry.
