Legal Question in DUI Law in Florida

My husband was convicted of dui in 2001. He is wishing to get a new job, the question on the applcation is ''have you ever been convicted of a felony''. Is every dui a felony? I do not remember any reference to a felony in the court proceedings, it was his first offense and served probation and community service. Does he have to answer yes to the question regardng felony conviction?

If it is a first time standard DUI that was resolved before a Judge in County Court then the answer to ''have you ever been convicted of a felony'' would be no. There are certain circumstances wherein a DUI can be charged as a felony but it sounds as if it was not the case in your husbands matter.
