Can I sue for Mother's Share of Estate
Can I sue my father for my mother's share of the estate? My father is planning to remarry. The house is still in both my parents names. The joint will, created in NJ and never changed, gives all to spouse.

Wills and other estate planning documents are always subject to challenge, however the standard to overturn such documents is very high. The will should be examined carefully to ensure that it is valid and all circumstances surrounding its creation should be considered. Also, some provisions in wills may not be valid, or may be superceded by other protections afforded to parties such as minor children or surviving spouses.
