Legal Question in Family Law in Florida

I have 2 childs; one; the boy is 10 years old and the girl is 7.

their mother demand me for chil suport 2 days ago.

can i try to have the custody of one of them? and in that case i do not have to pay the child suport to her and even she do not have to pay me the child suport also.

can i try to do that?

Yes, you can file a petition for custody for one or both of them, but remember three things:

1) You may not completely eliminate child support by getting custody of one of the kids. Your income may be different enough that one of you may still owe support to the other.

2) Your odds of getting custody if she's had custody after all these years may be slim. It may be obvious that you're just doing this to avoid support.

3) You shouldn't try to seek custody just to reduce or eliminate support. Remember, this is a child's life you're messing with. Ask for custody because it's the right thing for the kids (assuming it really is), not to getting out of paying support.
