would my 12yr old be able to speak for herself in court regarding visitation and over night stays

It's up to the judge, but almost certainly not. Judges are usually reluctant to allow 17-year-olds to testify. Twelve is just way too young. First, testifying could be damaging to a twelve-year-old. Secondly, who would the twelve-year-old want to live with? The one who lets her stay up at night? The one who lets her slide on her homework? The one who says vegetables aren't important? The one who lives closest to her boyfriend?
